What is Probate?
When you die with a will you most likely will have to go through some type of probate process. But what exactly is probate? Probate is the legal procedure through which a deceased person's debts are paid and distributions are made.
Probate with a Will
These steps include validation of the will and appointment of an independent executor and payment of debts and distribution of property. The court will validate the will and appoint an executor during a brief hearing before a judge. After the hearing, the court issues letters testamentary to the executor which gives the executor power to handle matters regarding the probate. Next, the executor will inventory the assets and property of the estate and pay any valid debts and taxes or claims. Finally, the executor distributes the property to the beneficiaries named in the will.
When it comes to your estate, a will is the best tool for control and peace of mind for your family.
